Using the bot in a way that could harm or compromise the security, performance, or integrity of the bot or other users.

3. User-Generated Content

You are responsible for any content you upload, stream, or share via Diva. Diva does not store or retain your content permanently, but we may temporarily process the audio data required for streaming. You should ensure that you have the necessary rights or licenses for any content you play through Diva.

By using Diva, you represent and warrant that you have the right to stream or play any content and that it does not infringe on the intellectual property or privacy rights of any third party.

4. Data Collection and Privacy

5. Third-Party Integrations

We are not responsible for any content, services, or issues that arise from these third-party platforms.

While we implement industry-standard security measures to protect your data and interactions with Diva, we cannot guarantee the absolute security of information transmitted over the Internet or through our services. You are responsible for securing any accounts, access credentials, or other personal data related to your use of Diva.

7. Media Ownership and Licensing

Diva does not store, host, sell, or claim ownership over any music, video, or media content. When you execute a command, Diva retrieves content already publicly available on third-party platforms and delivers results solely to fulfill your request. No media is retained after delivery. No long-term caching, archiving, or redistribution occurs.

Diva remains inactive until you initiate an action. The system performs no automated operations. It does not independently collect media, bypass access restrictions, or retrieve content without explicit user instruction. Diva functions as a user-controlled utility that mirrors actions you could perform manually using a standard web browser.

Premium subscriptions do not grant media ownership or rights to copyrighted material. A premium plan unlocks enhanced technical features related to Diva's operation, such as higher usage limits, faster processing, improved queue management, and additional bot controls. These upgrades affect system functionality only. Media sources and their ownership remain unchanged.

All copyrights and licenses remain with their original owners. You are responsible for complying with the rules and license terms of the source platforms from which content is retrieved. Diva does not crawl the web independently, operate in the background without user input, or connect to private systems requiring authentication. Every action begins with a direct user command.

8. Web Access and Automation Scope

Accessing publicly available websites through automated means follows standard web behavior. When software interacts with public pages in the same manner as a regular browser—without bypassing authentication, paywalls, private paths, or security barriers—no unauthorized access occurs.

Diva employs a browser-style approach to retrieve publicly accessible content. It does not mass-scan websites, passively gather data, or execute automated tasks without user input. Diva does not function as a scraping service. Each action is directly linked to a specific command you send. Without user input, Diva remains idle.

When websites attempt to restrict access to public pages through their terms of service, such limitations constitute contractual policy. They do not convert standard browsing behavior into unlawful activity. Diva is not obligated to enforce third-party terms designed to restrict access to publicly available content.

No malicious intent exists. No security safeguards are bypassed. No private data is accessed. All actions remain user-initiated, limited in scope, and equivalent to normal browser usage.

9. Termination of Service

We reserve the right to suspend or terminate your access to Diva at our sole discretion, without notice, for any reason, including but not limited to:

Violations of these Terms of Service.
Engaging in illegal or harmful activities.
Attempting to disrupt or abuse the bot's functionality.

Upon termination, you will no longer have access to Diva's features, and any permissions associated with your use of the bot will be revoked.

10. Disclaimers and Limitations of Liability

Diva is provided “as-is” and “as available” without any warranties or guarantees of any kind, either express or implied. We do not warrant that Diva will be uninterrupted, error-free, or free from viruses or other harmful components.

To the fullest extent permitted by applicable law, we disclaim all liability for any loss, damage, or injury arising from your use of Diva, including but not limited to, any third-party services integrated into the bot.

11. Indemnification

You agree to indemnify, defend, and hold harmless the developers and operators of Diva from any claims, damages, or liabilities arising from your use of the bot, including any breach of these Terms, violation of third-party rights, or illegal activity.

12. Governing Law

These Terms will be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the United States.
